Since USBCheck was written before WinME existed, this should not surprise you.
Which device are you having trouble with? What is the approximate percentage of PCs with the problem?

: Here is the scenario: After installing software meant for win98se and higher on a Dell WINme computer. The hardware drivers loaded no problem no conflicts in device manager but when tryng to run the software n video device was detected. So we ran the intel check usb and the diagnostic came back that the Win95 system should be updated to Win98 again I state it is on a winme os. The chipset is a 82801 ba/bam chipset. So when I went to check the chipset matrix WINme for the 820 chipset does not require any updates.
